Abstract

Suvremeni uvjeti doveli su do situacije gdje na globalnoj razini i na razini EU-a sudjeluje sve više osoba i skupina, u procesima lobiranja raspolaže se sve većim financijskim sredstvima te je utjecaj lobista na donošenje javnih odluka EU-a na svome vrhuncu. Proces donošenja javnih politika EU-a otvara sve veći prostor za procese lobiranja, odnosno zastupanja interesa, kao važne komponente donošenja političkih odluka. Glavnu lobističku riječ i dalje vode financijski najveće svjetske i europske korporacije poput Google-a, Apple-a, Microsofta, Amazona i Facebooka. Akt o digitalnim uslugama, točnije akt o regulaciji protoka podataka u digitalnom prostoru, aktualni je primjer procesa lobiranja čija je konačna formulacija dugo u izradi a bitan čimbenik odgovoran za to jest upravo lobiranje. Lobiranje vezano uz taj Akt jasno prikazuje današnje stanje odnosa moći u sferama lobista velikih korporacija i institucija Europske Unije. Lobiranje se ne veže striktno uz jednu strategiju ili kanal utjecaja, već same okolnosti i postavke svakog individualnog predmeta lobiranja određuju korake u njegovom postupanju. Tematika zakona određuje aktere, sukobljene lobističke strane, strategije ali i financijske mogućnosti pristupa. Svrha rada je prikazati suvremeni način političkog donošenja odluka u Europskoj Uniji koji sve više, zahvaljujući zamahu lobiranja, postaje dostupniji svima, uz odgovarajuću startegiju i financijske resurse. Lobiranje u Europskoj Uniji postaje sastavni dio redovnog svakodnevnog političkog života.

Abstract (english)

Modern conditions have led to a situation where more and more people and groups are politically participating on global and the EU level, increasing financial resources are available in the lobbying process and the influence of lobbyists on EU public decision-making is at its peak. The EU policy-making process opens more space for lobbying as an important component of political decision-making. The main lobbying word is still led by the financially largest world and European corporations such as Google, Apple, Microsoft, Amazon and Facebook. The Act on Digital Services, more precisely the Act on the Regulation of Data Flow in the Digital Space, is a current example of a lobbying process whose final formulation has been under development for a long time and lobbying is an important factor responsible for it. Lobbying in connection with this Act clearly shows the current state of power relations in the spheres of lobbyists of large corporations and institutions of the European Union. Lobbying is not strictly tied to one strategy or channel of influence, but the circumstances and settings of each individual subject of lobbying determine the steps in its conduct. The subject matter of the law determines the actors, conflicting lobbying parties, strategies, but also the financial possibilities of access. The purpose of this paper is to show the modern way of political decision-making in the European Union, which is increasingly, thanks to the momentum of lobbying, becoming more accessible to everyone, with the appropriate strategy and financial resources. Lobbying in the European Union is becoming an integral part of regular daily political life.
