Abstract

Ovaj rad sadrži historijski pregled pet regulatornih okvira javne nabave u okviru prava Europske unije. Postupci javni nabave imaju značajan utjecaj na kretanje BDP-a država članica Europske unije. Također, ti su postupci još uvijek veoma podložni pojavama poput korupcije, sukoba interesa itd. Analizom prakse Suda EU, strateških prioriteta za javnu nabavu Europske komisije i transformacija regulatornih okvira, uključujući najnovije Direktive i najznačajnije novine koje se u njima uvode, prikazano je do koje je mjere postojeći regulatorni okvir prava javne nabave EU kompatibilan s ciljevima strategije ''Europa 2020'' za pametan, održiv i uključiv rast, uključujući sve okolišne i socijalne kriterije i suzbijanje korupcije, ali i sa specifičnim načelima javne nabave, deriviranima iz prvog stupa Prava Zajednice. Također, postoji potencijalni konflikt načela slobodnog tržišnog natjecanja i učinkovitosti postupka (kao primarnih ciljeva javne nabave) s principom održive nabave. Nadalje, važno je napomenuti da je postojeći regulatorni okvir javne nabave EU implementiran u Zakon o javnoj nabavi RH (2016.).

Abstract (english)

This paper contains historical overview of five regulatory and legal frameworks of public procurement in the law of the European Union. Public procurement procedures have a major influence on changes in GDP of member states of the EU. Also, these procedures are still very much vulnerable to corruption, conflict of interests etc. By examining the practice of the European Court, strategic priorities of the European Commission and transformations of regulatory frameworks, including the newest Directives with its most significant novelties, it is shown to which extent the existing framework of European Union public procurement law is compatible with the goals of 'Europe 2020' strategy, including all the social and environmental criteria and fight against corruption, but also with the specific public procurement principles, derived from the first pillar of the Community Law. There are also problems concerning potential conflict between free market principles and process efficiency (as primary goals of public procurement) and the principle of sustainable procurement. Furthermore, it's important to notice that the existing public procurement regulatory framework of the EU is implemented in the Croatian Law on public procurement (2016.).
