Abstract

Ovaj rad bavit će se kaznenom politikom prema maloljetnicima u Republici Hrvatskoj u razdoblju od 1993. do 2013. godine. Koristeći kao teorijsku podlogu radove Michela Foucaulta pokušat će se razjasniti djelovanje disciplinskog aparata sa svrhom kažnjavanja i ispravljanja kaznenih djela počinjenih od strane maloljetnika te će se ukazati na jaz između normativnog razvoja kaznenih mehanizama i njihove implementacije u praksi što posljedično dovodi i do recidivizma ako se kazneni mehanizmi efikasno ne primjenjuju. Motivaciju za odabir ove teme pronašla sam još na preddiplomskom studiju politologije na Fakultetu političkih znanosti, slušajući predmet ˝Država i nasilje: uvod u studij kaznene politike˝, a osobno mi se segment maloljetničkog nasilja i kriminala u društvu te njegova kontrola istaknuo kao bitan faktor za budućnost društva. Knjiga Nadzor i kazna Michel Foucaulta koja mi se pokazala korisnim teorijskim poticajem za razvoj teme diplomskog rada o kaznenoj politici prema maloljetnicima u Republici Hrvatskoj. Natjerala me na razmišljanje o odnosu disciplinarne moći prema maloljetnicima koji su ključni segment za razvoj svakog društva. Kako bi mogli pravilno provesti analizu te naposljetku donijeti ispravan sud o položaju maloljetnika u Republici Hrvatskoj s obzirom na djelovanje kaznene politike nužno je da se u obzir uzmu događanja u Hrvatskoj kroz posljednja dva desetljeća, točnije vremenski period od 1993. godine, jer se ranih 1990-ih uspostavlja novi poredak moći u izvanrednom stanju. Ovaj rad će ukazati na jaz koji postoji između teorijskog obrađivanja i praktičnog primjenjivanja kaznenih mehanizama prema maloljetnicima na način da će se obraditi pravnički tekstovi koji teorijski određuju kaznenu politiku, a zatim će se pomoću Godišnjeg izvješća o radu kaznionica iz 2013. godine, statističkih podataka o recidivizmu i udjelu maloljetnih počinitelja u ukupnom broju osuđenih te dokumentarnim filmom ˝Od 6 mjeseci do 3 godine˝ i filmom ˝Oblak˝, kao svojevrsnim zamjenskim etnografskim sredstvima, prikazati stvarna efikasnost primjene kaznene politike prema maloljetnicima. Novinski članci u ovom radu korišteni su kao prikaz posljedičnog šoka nakon što je stvarna situacija u kojoj se maloljetnici zateknu za vrijeme služenja kazne izašla na vidjelo.

Abstract (english)

This paper will deal with the penal policy towards juveniles in the Republic of Croatia from 1993 to 2013. Using the work of Michel Foucault as a theoretical background, I will try to clarify the effect of the disciplinary apparatus as a mechanism for the punishment and correction of offenses committed by juveniles. I will point out the gap between the normative development of criminal mechanisms and their implementation in practice, which consequently leads to recidivism if the effective mechanisms are not applied. I found the motivation for pursuing this topic at the undergraduate course of political science at the Faculty of Political Science, while attending the class ˝State and violence: an introduction to the study of the criminal policy˝. Personally, I think the topic of juvenile delinquency and the ways of controlling it stands out as an important factor for the future development of society. The book “Discipline and Punish” by Michel Foucault was very useful as a theoretical background for the development of my master’s thesis ˝Penal policy towards juveniles in the Republic of Croatia˝. It made me think about the relationship between disciplinary power and juveniles who are a key segment of the development of any society. In order to properly carry out an analysis and finally bring the correct judgment on the situation of minors in the Republic of Croatia due to the effect of penal policy, it is necessary to take into account developments in Croatia in the past two decades. More accurately, the period from 1993 onward because a new order of power was established in the early 1990’s during the Croatian war of Independence. This paper will point out the gap between the theoretical work and practical applying of criminal mechanisms. I will be using the Annual Report on the work of prisons from 2013, statistics on recidivism and the proportion of juvenile offenders in the total number of convicts and finally the documentary ˝From 6 months to 3 years˝, as a substitute for ethnographic resources which show the actual effectiveness of the application of penal policy for minors. Newspaper articles in this paper were used to show the general shock which followed after the actual situation in which the minors found themselves while serving the sentence came to light.
