Abstract

Politika zaštite prava potrošača kreira se na razini Europske unije, a obaveza je svake države članice osigurati minimalne standarde zaštite. Republika Hrvatska, primarno putem usklađivanja zakonodavstva s Europskom unijom, stvorila je pravne temelje za razvoj zaštite prava potrošača. Putem zakona i ostalih pravnih akata, identificirala je aktere zadužene za provedu politike zaštite potrošača, kao i mjere za provođenje istih. Nameće se pitanje, da li je implementacija politike zaštite potrošača u Republici Hrvatskoj uspješna, te kakvo je stanje prava potrošača? Odgovor na to pitanje može se pronaći putem analize službenih dokumenta te istraživanjima o pravima potrošača. Upravo zato, nameće se zaključak kako Republika Hrvatska nije uspjela implementirati politiku zaštite prava potrošača, te se određene poteškoće događaju u toj fazi policy procesa.

Abstract (english)

The European Union has created the Consumer Protection Policy and the obligation of each member state is to ensure minimum standards of consumer protection. The Republic of Croatia, primary through harmonization of legislation with the European Union, has created the legal basis for the development of consumer protection. Policy actors responsible for implementing Consumer Protection Policy as well as measures to implement the policy have been identified through laws and other legal acts. The question is whether the implementation of consumer protection policy in the Republic of Croatia is successful and what is the status of consumer rights? The answer to this question can be found through analysis of official documents and research regarding consumer rights. The conclusion is that the Republic of Croatia has failed to implement the consumer protection policy, ad certain difficulties occur at this stage of the policy process.
