Abstract

Ovaj rad bavi se europskom migrantskom krizom koja je počela 2015. i reakcijom EU na nju s namjerom da se prikaže sposobnost EU da adekvatno odgovori na izazove dolaska velikog vala migranata. Obrađeni su temeljni dokumenti EU prije nastanka migrantske krize gdje je prikazan razvoj dokumenata i spremnost EU na reakciju u slučaju nastanka većeg migrantskog vala. Slijedi prikaz dokumenta koji su reaktivno izrađivani tijekom migrantske krize kao što je Europski migracijski program iz 2015. te reakcije država članica koje nisu postupale sukladno potpisanim aktima te su na taj način izbjegavale načela odgovornosti i solidarnosti prema ostalim članicama. Rad prati razvoj zajedničkog europskog sustava azila (CEAS) kroz koji su definirane politike azila i migracija te inertnost država članica u prihvaćanju normi te potpuno izbjegavanje pojedinih članica primjene potpisanih procedura. Kroz primjere Njemačke i Mađarske, država koje su suspendirale Dublinsku regulativu iz različitih motiva, prikazani su različiti pristupi migrantskoj krizi koji su na kraju obje države dovele do željenog cilja. Kroz širenje ovlasti agencijama Frontex i nove Agencije EU za azil (EUAA) vide se napori EU za rješavanje statusa migranata kroz politiku odvraćanja i vraćanja u države iz kojih su potekli, ali se takvi postupci mogu dovesti u vezu s kršenjem prava migranata. Kroz rad se želi prikazati da EU nije bila spremna na migrantsku krizu te da nije adekvatno odgovorila na nju te da i dalje nema spreman odgovor ukoliko dođe do novog migrantskog vala, a prvenstveno jer države članice ne uspijevaju pronaći model zajedničkom postupanja i donošenja zajedničke politike azila i migracija.

Abstract (english)

This paper deals with the European migrant crisis that began in 2015 and the EU's reaction to it with the intention of showing the EU's ability to adequately respond to the challenges of the arrival of a large wave of migrants. Basic documents of the EU before the emergence of the migrant crisis were discussed, where the development of the documents and the readiness of the EU to react in the event of a larger migrant wave were presented. The following is a presentation of documents that were reactively created during the migrant crisis, such as the European Migration Program from 2015, and the reactions of member states that did not act in accordance with the signed acts and thereby avoided the principles of responsibility and solidarity towards other members. The work follows the development of the Common European Asylum System (CEAS), through which asylum and migration policies are defined, as well as the inertness of member states in accepting the norms and the complete avoidance of certain member states from applying the signed procedures. Through the examples of Germany and Hungary, countries that suspended the Dublin Regulation for different reasons, different approaches to the migrant crisis were presented that eventually led both countries to the desired goal. Through the expansion of the powers of Frontex and the new European Union Agency for Asylum (EUAA), the EU's efforts to resolve the status of migrants can be seen through the policy of deterrence and return migrants to the countries from which they came but such actions can be linked to the violation of migrants' rights. The paper aims to show that the EU was not prepared for the migrant crisis and that EU did not adequately respond to it, and that EU still does not have a ready response if a new wave of migrants occurs, primarily because the member states fail to find a model for joint action and adoption of a common asylum policy and migration.
